Squarespace provides several services and features that use large language models (“LLMs”), natural language processing (“NLP”), machine learning (“ML”), generative artificial intelligence (“GAI”) and other artificial intelligence (“AI”) technologies (collectively, “AI Technologies”). These portions of our Services may enable you to (a) directly generate text, code, scripts, images or other content or materials using AI Technologies (“Content Generating Features”); (b) use pre-generated text, images, audio, videos or other content or materials generated by Squarespace using AI Technologies (“Licensed Pre-generated Content”); or (c) engage in conversational chat features that provide responses to questions or to other user input, and/or make or suggest changes to Your Sites or other Squarespace subscription, or parts thereof, responsive to user input, as further described below (“Conversational AI Features”) (the foregoing subparts (a)-(c), collectively, the “Squarespace AI Features”).
These AI Terms, along with our Terms of Service and any policies or other legal terms referenced herein or therein, apply to your access to and use of the Squarespace AI Features. These AI Terms are incorporated by reference into our Terms of Service. Any capitalized terms (or lowercase terms specifically defined in our Terms of Service) not defined in these AI Terms have the meanings set forth in our Terms of Service or Product Specific Terms. Except as otherwise expressly set forth in these AI Terms, in the event of a conflict or inconsistency, our Terms of Service shall govern, followed by these AI Terms.

1. Content Features
1.1. Content Generating Features
1.1.1. The Content Generating Features enable you to provide text or other User Content (“Customer GAI Input”) and receive in return text, code, scripts, images or other content or materials (“Customer Generated Output”) using AI Technologies. The Content Generating Features use GAI and include generative AI Technologies commonly referred to as text2text, text2image, image2image, text2video etc.
1.1.2. Ownership of Customer GAI Input and Customer Generated Output. Subject to the provisions of these AI Terms and notwithstanding any provision to the contrary in our Terms of Service, to the extent Customer Generated Output may be owned under applicable laws, as between you and Squarespace, you are the owner of all Customer GAI Input and Customer Generated Output.
1.1.3. Customer Generated Output May Not Be Unique. Customer Generated Output may not be unique, whether across multiple Squarespace users or other users of content generating software provided by AI Software Service Providers (as defined below). For example, if you and another user provide the same or similar Customer GAI Input in connection with the Content Generating Features, you and the other user may each receive the same or similar Customer Generated Output. Even if Customer Generated Output received by another user is the same as Customer Generated Output received by you, only Customer Generated Output received by you is your User Content, and similar Customer Generated Output received by the other user is their User Content.
1.1.4. User Content. Customer GAI Input and any Customer Generated Output are your User Content and are subject to the provisions relating to User Content in our Terms of Service.
1.2. Licensed Pre-generated Content
1.2.1. Licensed Pre-generated Content is any text, images, audio, videos or other content or materials created directly by Squarespace using AI Technologies. In contrast to the Content Generating Features and Customer Generated Output, Licensed Pre-generated Content is not generated as a direct response to content or other input you provide to Squarespace, but rather pre-generated by Squarespace. Licensed Pre-generated Content is made available as part of various features throughout the Services.
1.2.2. License Grant for Licensed Pre-generated Content. For each piece of Licensed Pre-generated Content that you use as permitted herein and as intended by the Services, solely in connection with your use of the Services, we grant you a limited, non-exclusive, worldwide right and license to use such Licensed Pre-generated Content solely as permitted to be used via the Services and solely as intended to be used via the Services; provided, however, that no trademark licenses are granted hereunder or otherwise through these AI Terms or elsewhere in the Agreement. You may not use Licensed Pre-generated Content in any way, intentional or otherwise, that competes, as determined by us in our sole discretion, with the Services.
1.2.3. Restrictions. You acknowledge and agree that Licensed Pre-generated Content is subject to the following: (a) Licensed Pre-generated Content is neither sold nor distributed to you; (b) you may only use the Licensed Pre-generated Content in connection with your use of the Services; (c) your ability to use Licensed Pre-generated Content is, for each particular piece of Licensed Pre-generated Content, limited by our rights and applicable restrictions; (d) you may only use Licensed Pre-generated Content as permitted and as intended by the Services; (e) unless we tell you otherwise, you may not and you may not enable others to download, store, modify, edit, reverse-engineer, decompile, disassemble, reverse compile, remove metadata from, create derivative works of or attempt to derive the source code from the Licensed Pre-generated Content; (f) unless we tell you otherwise, you may not use Licensed Pre-generated Content in logos, trademarks, service marks or other branding or identifiers; (g) you may not use Licensed Pre-generated Content: (i) on a standalone basis without any User Content; (ii) in retail or on-demand products, such as e-cards, ringtones or screensavers; (iii) for the purpose of file sharing of the Licensed Pre-generated Content; (iv) in a software application or video game; or (v) in a way that represents you as the creator of a piece of Licensed Pre-generated Content; (h) you may not sell or re-sell Licensed Pre-generated Content; and (i) we reserve the right, which we may exercise at any time and in our sole discretion, and without liability or notice to you, to change, terminate, suspend, restrict, disable or discontinue providing pieces of or all of the Licensed Pre-generated Content.
1.3. Litigation. If you institute litigation or other proceedings against Squarespace, our affiliates or our subsidiaries alleging that any Customer Generated Output or Licensed Pre-generated Content (collectively, “GAI Content”) infringes the intellectual property or other rights owned or licensed by you, then any licenses granted to you under these AI Terms or elsewhere in the Agreement (including any and all terms incorporated by or referenced therein or thereto) shall terminate as of the date such litigation or claim is filed or instituted. You agree to indemnify and hold harmless Squarespace and its affiliates and its and their directors, officers, employees and agents from and against any Losses arising out of or related to your use or distribution of the GAI Content.
2. Conversational AI Features; Chatbots
2.1. The Conversational AI Features enable you to, through for example a chat interface, ask questions, seek assistance, gain business or other insight into Your Sites or your subscriptions, request an action, or request suggestions, and, in response, the Conversational AI Features use AI Technologies to: (a) provide answers, guidance, support resources, or other replies; (b) edit, add, enable, disable, remove, publish, purchase, alter, change and/or modify any of Your Sites or any subscriptions, or any feature, option or setting therein; or (c) suggest any of the foregoing in subpart (b) (the foregoing subparts (a)-(c), collectively, “Chat Output”). “Chat Input” means the text, prompts, images, audio, data, or other content or materials provided by you through the Conversational AI Features.
2.2. The Conversational AI Features may also enable or otherwise facilitate the Content Generating Features as set forth in Section 1.1 (Content Generating Features); content-related Chat Output is considered Customer Generated Output and Section 1.1 (Content Generating Features) governs.
2.3. By using the Conversational AI Features, you acknowledge and agree that (a) Squarespace has no obligation to review or monitor any Chat Input or Chat Output; and (b) use of or reliance upon Chat Output is at your own risk.
3. Warning about Squarespace AI Features; Disclaimer
3.1. Squarespace AI Features use and incorporate new and emerging AI Technologies. You acknowledge that: (a) Customer Generated Output, Licensed Pre-generated Content, and Chatbot Output (collectively, “Output”) may be inaccurate, incorrect, erroneous, strange, incomplete or not fit for use or purpose; (b) AI Technologies may not accurately assess or respond to linguistic subtleties, including, colloquialisms, vernacular, figures of speech, jargon, idioms, metaphors, slang, cultural nuances and linguistic evolution; and (c) AI Technologies may have difficulty with lengthy or complex prompts, conversations, interactions, Inputs, Outputs, tasks or business processes. Customer GAI Input and Chat Input are collectively referred to herein as “Input.”
3.2. To the fullest extent permitted by applicable law and notwithstanding anything to the contrary herein, Squarespace makes no warranties, either express or implied, about Squarespace AI Features or any Output. The Squarespace AI Features and Output are provided “as is” and “as available.” Squarespace also disclaims any warranties (whether express, implied or arising from statute), including all warranties of merchantability, fitness for a particular purpose, non-infringement, satisfactory quality, title, quiet enjoyment and any warranties arising out of course of dealing or trade usage. Squarespace makes no warranty or representation that the Services will: (a) be timely, uninterrupted, error-free or secure; (b) meet your requirements or expectations; (c) be free from viruses or other harmful components; or (d) free from defects or that defects will be corrected. Additionally, Squarespace makes no warranty or representation that any Output may be eligible for intellectual property protection, whether registered or unregistered. Use of the Squarespace AI Features and/or Output is voluntary and strictly at your own risk. You are solely responsible for any activity on your Accounts, the content you create using our Services and the content you post to Your Sites or otherwise make available over the Internet via our Services. Please use your discretion before relying on, publishing or otherwise using Output. YOU ACCEPT AND AGREE THAT ANY USE OF OUTPUT IS AT YOUR OWN RISK AND YOU WILL NOT RELY ON ANY OUTPUT AS A SOLE SOURCE OF TRUTH OR FACTUAL INFORMATION OR AS A SUBSTITUTE FOR PROFESSIONAL ADVICE.
4. Your Responsibilities
Notwithstanding anything to the contrary herein, you are responsible for: (a) ensuring the accuracy, reliability, utility and completeness of all Output (including without limitation through reviewing and testing all Output) before publishing, distributing, displaying, sharing, relying on, or otherwise using such Output; (b) deciding whether to edit, add, enable, disable, remove, publish, purchase, alter, change and/or modify Your Sites or your subscriptions, or any content, feature, option or setting therein, or otherwise use Output; (c) deciding to automate or to rely on Squarespace to aid your automation of anything set forth in subpart (b); (d) ensuring that Input, Output, your use of the Squarespace AI Features and your use of Output complies with applicable laws; and (e) ensuring that Input and Output complies with these AI Terms and our Terms of Service, Acceptable Use Policy and the rest of the Agreement. Subpart (c) in the foregoing sentence includes without limitation requirements under applicable law relating to marking, watermarking, notice/disclosure, metadata, and copyright management information.
5. Additional Restrictions on Use of the Squarespace AI Features
In addition to the restrictions on use of our Services in our Acceptable Use Policy, you may not use Squarespace AI Features in the following ways: (a) to mislead or attempt to mislead End Users or any others with access to the Output that such content or information was human-created; (b) to create or cause the creation of Output which could reasonably be construed as: (i) medical advice or medical diagnostic or treatment information, or (ii) legal, financial (including tax and investment) or other professional or regulated advice or information; (c) to create, or cause the creation of, or use Output to condone, enable, promote or commit any act: (i) of violence, (ii) that could result in death or personal injury, or (iii) which violates applicable law; (d) to avoid, bypass, remove, deactivate, impair, defeat, jailbreak, hack, reverse engineer or otherwise circumvent any technological or other measure that is intended to: (i) filter, restrict, moderate, control, limit, monitor or review Input or Output, (ii) improve, apply or implement security, safety, trust, ethical, bias mitigation or related controls, or (iii) reduce or mitigate harm, harmful Input or Output, or any prohibited activity set forth in Section 6 of our Acceptable Use Policy; (e) to attempt to do any of the activities in the preceding subpart (d); or (f) to provide Input which constitutes personal information of yourself or anyone else, including without limitation name, email address or data concerning an individual’s race, ethnicity, nationality, health status, religious beliefs, gender identity or sexual orientation. For the avoidance of doubt, applicable law includes without limitation any law and regulation that prohibits or otherwise restricts the creation of certain types of content (in whole or in part), including Output, using AI or automated means, and/or the publication or other dissemination thereof. For purposes of illustration, such content includes political, pornographic, intimate or nonconsensual ‘deepfakes’ as such terms are defined by the applicable laws that prohibit or otherwise restrict such content.
6. AI Software Service Providers
The Squarespace AI Features are facilitated by AI Technologies provided by third party service providers (each, an “AI Software Service Provider”). More information on our AI Software Service Providers may be found here. If you use the Squarespace AI Features, Input may be shared by Squarespace to the applicable AI Software Service Provider and Output may be generated by the applicable AI Software Service Provider. Accordingly, in addition to the license you grant to us under Section 2.2 of our Terms of Service, you also grant Squarespace a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable, transferable right and license to: (a) as necessary to provide you the Squarespace AI Features, transmit Input to the applicable AI Software Service Provider for such AI Software Service Provider to use in accordance with its terms and policies; and (b) enable the applicable AI Software Service Provider to use any Output generated from Input in accordance with its terms and policies.
7. Modification
We may modify these AI Terms from time to time, and will post the most current version on our site. If a modification meaningfully reduces your rights, we may notify you in accordance with the procedures set forth in our Terms of Service. By continuing to use or access any portion of the Content Generating Features after any modifications come into effect, you agree to be bound by the modified AI Terms and price changes, if any. If you disagree with our changes, then you must stop using the Content Generating Features.
